USCIS Delays Implementation of Notice to Appear Policy Memorandum

On July 30, 2018 USCIS announced that the agency would delay implementation of Policy Memorandum 602-0050.01, Updated Guidance for the Referral of Cases and Issuances of Notices to Appear (NTAs) in Cases Involving Inadmissible and Deportable Aliens. This “NTA Memo” was previously released on June 28, 2018. For information on the changes the NTA Memo makes to existing policy, please refer to our previous alert, available here.

The NTA Memo required USCIS to issue operational guidance within 30 days of how the new policy would be implemented. However, at this time, operational guidance has not been released and is still pending. USCIS is therefore delaying implementation of the NTA Memo until the operational guidance is issued. The postponement does not provide a specific date when issuance of the operational guidance is expected.
