USCIS Announces Second Random Selection

This message is meant only for those clients who have filed an H-1B Cap Registration in the FY 2024 Cap Lottery. If that does not apply to you, you may ignore this message.

USCIS has announced that they will conduct a second random selection from the previously submitted FY 2024 H-1B Cap Registrations.

By now, most H-1B registrants have made alternative plans either to leave the U.S. or continue in a different immigration status. Some have moved to a new employer altogether. If you had an H-1B Cap Registration that was not selected, please check for messages from your attorney.

Our firm will email clients as soon as we get notice from USCIS that it has conducted the second round. We will let each registrant know whether they were selected or not and what the next steps are. We will usually have 90 days from the date of the selection notice to file. However, as the start date is typically October 1, our intention is to file the H-1B cap petition as soon as possible so that the employee can start employment as close to October 1 as possible.

As an H-1B registrant and employer, please be prepared to answer whether you intend to file the H-1B cap case. With several months having passed since the first lottery, circumstances may have changed on either the employee’s or employer’s part.
